The following Terms and Conditions apply to all visitors and customers of Arcádia® – a registered trademark managed and operated by Confeitarias Arca e Arcádia S.A. and Coffee Box-Cafetaria S.A. –, as well as to Clube Arcádia members and all commercial transactions carried out through our digital platforms.

 

This document sets out the conditions associated with the use of this website https://arcadiachocolates.com, which applies to individuals and legal entities, as well as to any commercial transactions carried out.

 

By accepting these Terms and Conditions, you declare that you have read, understood, and fully agree with their content. We therefore advise you to read these general terms and conditions carefully before using our website.

 

By using this website, the User/Customer acknowledges that they must comply with all terms and conditions and with our privacy policy. Consequently, if they do not agree with any of our policies, they should not use this website.

 

These terms and conditions define the general terms of sale applicable to contracts entered into through our website, from order processing to the various services provided, including payment methods and conditions for delivery of the goods.

 

We emphasize that, whenever justified, these terms and conditions may be amended unilaterally. We therefore recommend reading them carefully and periodically.

USE OF THE WEBSITE

 

Registration on the Arcádia® website is permitted only for users who are legally capable of entering into contracts and who act solely in their own name and on their own behalf.

 

Any activity or participation by users under 18 years of age is considered illegal and will not be tolerated by Arcádia®. Access to and use of Arcádia® features, directly or through another person, is prohibited for all minors and adults under guardianship whose court-ordered measure prevents them from entering into these transactions.

 

In the case of a legal entity, the User/Customer declares that they are its representative and have the authority to carry out the act.

 

When using the Arcádia® platform and placing orders, the User/Customer undertakes to comply with these terms and conditions, in particular:

 

 

1 - Do not use the website for purposes other than obtaining information about the products and their respective terms of sale and/or purchasing them;

 

2 - Accurately, completely, and truthfully complete all electronic forms relating to user registration, the placing of orders, and any others made available on the website that they may use;

 

3 - Keep their user code and access password (‘Password’) confidential and do not disclose them to third parties;

 

4 - Do not use the website or any of the platforms and forms made available through it to disseminate illegal, unlawful, or offensive content contrary to general legal principles, ethics, or public order;

 

5 – Refrain from using the website to make legally invalid inquiries or orders;

 

6 – Refrain from disclosing or disseminating any insulting, misleading, defamatory, obscene, xenophobic, or discriminatory messages or information, or any content that in any way violates the privacy or intellectual or industrial property rights of third parties, as well as any information that may be harmful to third parties or to the domain owner;

 

7 - Fully comply with all terms of use of the website, as well as with transactions and contracts concluded through it.

 

 

To place product orders through the Arcádia® website, the User/Customer must first register as a user by completing the relevant form available online.

 

The User/Customer is responsible for keeping their user registration details, including address information, up to date at all times. If the user believes at any time that the confidentiality of their data has been compromised, they must inform Arcádia® immediately via online@arcadia.pt.

 

Arcádia® shall not be liable for delays in processing any order or for its loss resulting from incorrect or insufficient information provided by the User/Customer.

 

After registering as a user, the User/Customer may place orders by using the “virtual shopping cart” and following all the steps, including those relating to payment.

 

Arcádia® accepts no responsibility for transactions carried out through the user’s account, whether or not the user acknowledges them.

 

Arcádia® considers the user’s session valid from the moment they log in with the correct username and password. From that moment onward, Arcádia® cannot be held responsible for the unauthorized use or improper handling of personal data.

 

If any activity on a user account is identified that could be considered fraudulent and does not comply with the activities covered by these Terms and Conditions, or if consumption patterns or systematic repetitions are detected that could indicate irregular or unlawful behavior, Arcádia® reserves the right to investigate those activities, disclose the results of its investigations to the competent authorities, cooperate with them, and comply with their instructions.

 

PRICES, CHARACTERISTICS AND AVAILABILITY OF PRODUCTS:

 

If the information presented on the website does not correspond to the product's characteristics, the User/Customer has the right to terminate the online purchase and sale agreement in accordance with the applicable legal provisions and without prejudice to the conditions set out below.

 

The User/Customer expressly accepts and declares that they are aware of the product specifications when placing their order and agree to them.

 

In the event of incorrect information on the Arcádia® website regarding product specifications that could reasonably have been understood by the User/Customer at the time of ordering, such information shall not be enforceable against Arcádia® under any circumstances.

 

The photographs shown on the website are for illustrative purposes only. Therefore, we recommend that you consult the product details for more information about the characteristics of the items you intend to purchase.

 

Please note that if the product shown is not available for delivery but can be made to order, it may not be exactly the same as the one shown in the photograph, due to the essentially artisanal and/or manual production process.

 

Product prices and specifications are subject to change without prior notice. Despite Arcádia®'s utmost care to keep all information up to date, some products may contain an incorrect price, so we will always verify prices when processing orders. If this occurs during order processing, Arcádia® will inform the customer accordingly. In such a case, the customer:

 

●You will be refunded the difference if the advertised price is higher than the actual sale price;

 

●You may choose to cancel the order or, after being informed of the actual price and while still wishing to proceed, pay the difference if the actual price is higher than the advertised price.

 

Arcádia® shall under no circumstances be required to supply any product at a lower price (even after the order confirmation or its dispatch has been sent) if the pricing error is obvious and unequivocal, and the User/Customer could reasonably have recognized it as an incorrect price.

 

The stated stock availability and delivery times are merely indicative.

 

Arcádia® is not responsible for any discontinuation in the production or sale of the products listed on its website.

 

If, due to stock unavailability or delays in processing or dispatching the products ordered by the customer, it is impossible to fulfill the order within the stated delivery period plus five business days, Arcádia® will contact the customer, who may choose to keep the order and accept the new stated delivery period or cancel it, in which case any amount already paid will be refunded.

 

Pursuant to Decree-Law No. 7/2004 of January 7 (as amended by Decree-Law No. 62/2009 of March 10 and Law No. 46/2012 of August 29), concerning electronic commerce, Arcádia® reserves the right to unilaterally cancel the order whenever there is a programming error, computer malfunction, or the contractual offer reaches its destination in a distorted form and the error concerns an essential element of the contract.

 

The stated product price is, unless there is an input error or otherwise indicated, the retail price (including VAT at the legally applicable rate). The price of any purchase made through the website is valid on the day the order is placed and paid for.

 

The advertised prices do not include shipping costs, which will be indicated to the User/Customer before the order is confirmed.

 

Shipping costs are included in the price when the order is finalized.

 

All data recorded by Arcádia® constitutes proof of all transactions carried out between the Seller and the final Consumer, and Arcádia® is responsible for archiving the electronic document formalizing the contract and undertakes to keep it accessible.

 

PLACING ORDERS:

 

To place an order online:

 

1. Register or log in to access your customer account.

 

2. Browse the online store pages and find the product(s) you wish to purchase.

 

3. Add your preferred products to the Shopping Cart using the “Add to cart” button.

 

4. Once you believe you have selected all the products you wish to purchase, go to the Shopping Cart page via the icon and complete the order by clicking “Checkout”.

 

5. Make the payment through the electronic platform provided.

 

6. You will receive an email confirming the availability of the selected product(s) and the order, as well as confirming the expected delivery time frame and method.

 

 

PAYMENT AND PAYMENT METHODS

 

You can make payments using:

 

·        Credit or debit cards;

·        Multibanco reference;

·        MB WAY;

·        PayPal;

·        SeQura (+info).

 

Orders become effective after payment through one of the payment methods made available by Arcádia® for online purchases on the website. Your banking details will never enter Arcádia®'s computer system.

 

For electronic payments by credit or debit card, Multibanco reference, or MBWAY®, a payment platform provided by SIBS is used, ensuring service quality and the highest security guarantees. You can view this partner's Privacy Policy here.

 

The SeQura payment method allows you to split your order payment into three installments for purchases between €50 and €3,000. Learn more about this payment method here. ONLINE STORE SECURITY

 

The Arcádia® online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial moment of your transaction until the order is processed, and will not be stored on any public server.

 

Although we use highly advanced encryption software, any payment transmitted over the Internet or by email carries certain risks, particularly when the Customer fails to take the necessary precautions and does not act responsibly.

 

Arcádia® cannot be held liable for any damage suffered as a result of using electronic means of communication, namely damage arising from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties, or computer programs used for communications or virus transmissions.

 

SHIPPING AND DELIVERY

Where?

 

At present, we only accept orders with a delivery address in Portugal and peninsular Spain, as it has not yet been possible to establish a logistics and transport network that guarantees the quality and food safety of the artisanal chocolate produced by Arcádia for shipments to the remaining countries of the European Union.

 

Discount codes associated with Shipping Costs are only valid for orders placed for mainland Portugal and peninsular Spain.

 

The customer's details must be completed fully and accurately. Incorrect or incomplete information may result in the order not being dispatched or may prevent successful shipment and delivery, for which Arcádia® accepts no responsibility. Any changes made to your account after placing an order will not be taken into consideration for that order, but only for future orders you place.

 

Someone must be present to receive your order, as we only guarantee the full quality of the product until the delivery time limit. After that time, we are not responsible for the quality and/or presentation of the product.

 

For your convenience, you may request that your order be sent to another address of your choice. Make sure you enter the full address, as well as a contact name (if different) and a national mobile phone number to facilitate immediate delivery of your order.

 

If no one is found at the indicated address to receive the order within the scheduled time, the carrier will attempt to contact the telephone number provided in the purchase order to arrange another delivery time/date. If telephone contact is not possible, a notice will be left in the mailbox with a number the customer should call to reschedule the delivery. Nevertheless, the carrier will make a second attempt to contact the customer using the telephone number provided in the purchase order to schedule a second delivery attempt. If this second telephone contact attempt to reschedule is unsuccessful, the order will remain at one of the carrier’s agencies for a maximum period of 15 (fifteen) days until it is possible to schedule the second delivery attempt. If delivery cannot be completed within these 15 (fifteen) days for reasons attributable to the customer, we will consider delivery of the product definitively impossible, with no right to any refund. If, during this period and after contacting the Arcádia® Customer Support team, the customer expresses the intention to schedule a third delivery attempt by the carrier, this will require an additional payment corresponding to the shipping fee charged in the online store, by bank transfer. Once proof of payment has been sent, the carrier will be instructed to make a third delivery attempt. Each additional delivery attempt for the customer’s order is subject to payment of additional shipping fees. During this period, and after consecutive failed delivery attempts, once the order’s delivery to the carrier’s agency has been confirmed, the customer may also choose to collect the order from the corresponding carrier agency. In all circumstances, whenever the product is delivered after the time limit or under circumstances extending beyond the normal delivery period agreed with the carrier, Arcádia® is not responsible for its quality or presentation.

 

When?

 

After payment and confirmation of the order by Arcádia® on business days by 12:00 p.m., the delivery time for products purchased online is 1 business day for products available for immediate dispatch and delivery addresses in mainland Portugal and mainland Spain. If payment and confirmation of the order by Arcádia® take place after 12:00 p.m. on business days or at any time during the weekend, the delivery time for products purchased online is 2 business days. Deliveries to the islands take 2 to 3 business days after payment and confirmation of the order by Arcádia®. All deliveries are made on business days only.

 

In the case of orders placed during festive periods and/or in the event of a stock shortage, the above deadline will not apply. The customer will be duly informed of the specific changes through a banner located at the top of the website.

 

How?

 

Your products will always be transported in suitable packaging so that they reach the recipient in perfect condition throughout the year, whether in winter or summer.

 

Arcádia® reserves the right not to ship its products in the event of specific weather conditions or natural disasters that it considers unsuitable and that could in any way compromise the product’s quality and presentation, in which case the customer will be notified as soon as possible. During periods of adverse weather conditions or natural disasters affecting the transport of Arcádia® products, the aforementioned terms and conditions and delivery times do not apply. The customer will be duly informed of the specific changes through a banner located at the top of the website.

 

Some of the information provided (Name, Address, Postal Code, City, Contact Details) will be shared with the partner responsible for the transport service so that deliveries of purchases made online can be completed. You will only be contacted if a delivery problem occurs. Your data will not be used for any other purpose. For more information, please see our Privacy and Personal Data Protection Policy.

 

How much?

 

For all orders placed in the Arcádia online store for delivery to mainland Portugal and mainland Spain through the partner responsible for the transport service, a transport charge of €5.75 will be added. This charge will be waived by Arcádia for purchases over €40.00.

 

For orders delivered to the Azores and Madeira through the partner responsible for the transport service, transport costs will be added according to the total weight of the order, regardless of the order value.

 

·        For the Azores, shipping costs range from €42.50 for orders weighing up to 2 kg to €105 for orders between 9 kg and 10 kg.

·        For Madeira, the amounts range from €57.50 for orders up to 2 kg to €117.50 for orders weighing between 9 kg and 10 kg.

 

TRANSFER OF RISK AND TITLE TO PRODUCTS IN ONLINE PURCHASES

If the User/Customer is considered a consumer under the terms defined in consumer protection legislation, the risk of loss or damage to goods shipped for delivery by Arcádia® passes to the consumer when the consumer or a third party indicated by the consumer, other than the carrier, acquires physical possession of them.

 

In all other situations, the risk of loss or damage to the goods passes to the User/Customer upon delivery of the goods to the carrier.

 

Upon delivery, the User/Customer must verify that the goods conform to the order, particularly the condition of the packaging, and inform the carrier of any damage detected, noting it on the delivery note they sign.

 

If the goods have damage that was not visible at the time of delivery but resulted from inadequate transportation, the customer must contact Arcádia®, preferably in writing, within 2 (two) days at the following email address: online@arcadia.pt.

RIGHT OF WITHDRAWAL FROM THE CONTRACT

It is important to Arcádia® that you are completely satisfied with your purchase.

 

Accordingly, if the User/Customer of Arcádia® products is considered a consumer for the purposes of consumer protection legislation and purchases the products through the online store, they have the right to withdraw from the contract within 14 (fourteen) days, calculated as follows:

 

-From the day on which the consumer or a third party, other than the carrier, indicated by the consumer acquires physical possession of the goods, in the case of sales contracts;

 

-From the day on which the consumer or a third party, other than the carrier, indicated by the consumer acquires physical possession of the last item, in the case of multiple goods ordered by the consumer in a single order and delivered separately;

 

-From the day on which the consumer or a third party, other than the carrier, indicated by the consumer acquires physical possession of the last lot or item, in the case of the delivery of goods consisting of multiple lots or items;

 

-From the day on which the consumer or a third party indicated by the consumer, other than the carrier, acquires physical possession of the first item, in the case of contracts for the periodic delivery of goods over a specified period.

 

If the products were purchased by a User/Customer who does not qualify as a consumer for the purposes of consumer legislation, the general rules shall apply.

 

If you are a consumer, you may exercise the right of withdrawal provided that the following conditions are met:

 

Presentation of the product purchase invoice;

The product must be returned in the same condition in which it was sold—of suitable quality and condition, with no signs of use or deterioration, and packaged in its respective packaging;

 

The contract cancellation request must be made by sending an unequivocal statement of the intention to cancel or, alternatively, the “Withdrawal Form” available here, stating the full name and order number, and must include photographic records of the product in order to assess its conformity.

 

The contract may be cancelled through one of the following methods and addresses:

If the User/Customer cancels the contract by email, Arcádia® will acknowledge receipt of the cancellation notice to the consumer within 24 hours.

 

If the User/Customer chooses to exercise the right of withdrawal by post, an acknowledgment of receipt of the cancellation notice on a durable medium will be sent within 48 hours.

 

If the right of withdrawal is exercised, the User/Customer shall bear the return costs in full.

 

The User/Customer is responsible for any loss in value of the purchased product(s) after delivery.

 

Likewise, the User/Customer shall be responsible for any defect or non-conformity found in the product(s) caused by their transportation, whenever this is not Arcádia®’s responsibility.

 

After exercising the right of withdrawal, the refund of the amount paid by the User/Customer, including, where applicable, any delivery costs paid when purchasing the goods, will be made after validation that the return conditions have been met, within a maximum period of 14 (fourteen) days.

 

For amounts paid by Credit Card or PayPal, the refund will be made to the same payment method. For amounts paid via Multibanco or MB WAY, the refund will be made by bank transfer, and the User/Customer’s IBAN will be requested during the refund process.

 

If the User/Customer wishes the refund to be made through a different method, they must, within 5 (five) days of sending the contract cancellation notice, notify their choice in writing, providing all the necessary information, through one of the following means:

The refund may be withheld until Arcádia® has received the goods being returned, or until the User/Customer provides proof that the goods have been sent, whichever occurs first.

 

The User/Customer must return the goods without undue delay and no later than 14 (fourteen) days from the day on which they informed Arcádia® of the withdrawal from the contract. This deadline shall be considered met if the User/Customer returns the goods before the end of that 14 (fourteen)-day period, provided that sending the products by mail is feasible without their deterioration, using a shipping method that ensures their quality and preservation. In this case, the User/Customer shall bear the full cost of returning the goods.

The following contracts are excluded from the Right of Withdrawal, as described above:

 

-The supply of goods made according to the consumer's specifications or clearly personalized;

 

-The supply of goods that, by their nature, cannot be returned or are liable to deteriorate or quickly become out of date;

 

-The supply of sealed goods that cannot be returned for health or hygiene protection reasons;

 

-The supply of goods that, after delivery and by their nature, become inseparably mixed with other items;

 

-Any other exceptions provided for in Decree-Law No. 24/2014 of February 14, where and insofar as applicable.

 

CONSUMER GOODS WARRANTY

Products sold to Users/Customers who are considered consumers for the purposes of consumer legislation are covered by the legal regime governing the Sale of Consumer Goods and the related Guarantees, approved by Decree-Law No. 67/2003 of April 8, as currently amended.

 

As a rule, the conformity of the purchased goods is guaranteed for a period of two years from the date of delivery of the product(s).

 

However, the food-related nature of the products sold means that the warranty period for food products supplied by Arcádia® may be shorter. The expiration dates are specifically indicated on all packaging of products supplied by Arcádia®, and these are the periods for which Arcádia® guarantees the conformity of the purchased goods.

 

If the purchased product presents any lack of conformity, the User/Customer must notify us of the situation in writing, providing their order number and a detailed description of the defect, including photographic records of it. This must be done by one of the following means:

The costs of returning or collecting items that do not conform to the contract and are still within the warranty period shall be borne by Arcádia®.

 

If the lack of conformity of the goods is confirmed, the User/Customer who is a consumer is entitled to have it remedied free of charge by means of repair or replacement, to an appropriate reduction in the price, or to termination of the contract.

 

The replacement of the product, its repair, termination of the contract, or reduction of the price must be carried out within 30 (thirty) days after verification of the defect.

 

If the inspection and assessment of the product(s) reveal signs of non-conformity, particularly regarding the preservation of the products, attributable to the User/Customer through intent or negligence, they will not be entitled to the guarantees mentioned above.

 

A request for replacement, a price reduction or termination of the contract must be submitted by email to online@arcadia.pt, specifying the full name, order number, chosen option of replacement, repair, price reduction or termination of the contract, and must include photographic records of the product.

 

In the event of replacement, Arcádia® will send the customer a new product, which will be delivered upon collection of the damaged product, at no cost to the Customer/User.

 

In the event of termination of the contract, Arcádia® will arrange for the product to be collected, and once the product has been delivered to its facilities, the full value of the product will be refunded.

 

For this purpose, the User/Customer must include their bank details in the email so that the refund can be processed.

 

LIABILITY

All products sold on the website https://arcadiachocolates.com comply with Portuguese legislation.

 

Arcádia® shall not be liable for losses resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent the User/Customer from accessing or browsing the website or receiving services.

 

Likewise, Arcádia® shall not be held liable if its failure to fulfil its obligations is attributable to an unforeseeable or insurmountable act by a third party or results from force majeure.

 

It is the sole responsibility of the User/Customer to keep their Customer account information correct and up to date through the Customer Area of our website or through our Customer Support service.

 

Arcádia® shall not be liable for any delay or inability to process the order, particularly at the time of delivery, resulting from incorrect or insufficient information provided by the User/Customer.

 

The item(s) sold are described and presented on the website as accurately as possible. If, despite all our precautions, errors occur on the Arcádia® website or in its catalogues, Arcádia® shall not be held liable for them.

 

Except in cases where the consumer protection legislation explained above applies, any transaction between Arcádia® and its Users/Customers that is not disputed through the appropriate channels within 6 (six) months shall not give rise to any claim against, or liability on the part of, Arcádia®.

 

The User/Customer does not have the right to transmit, assign, pledge, or otherwise transfer a contract or any rights and obligations arising from it for their benefit or to themselves without Arcádia®’s prior consent, given in writing on a durable medium.

 

Arcádia® may, at any time during the term of the contract, transmit, assign, pledge, subcontract, or otherwise transfer a contract or any rights and obligations arising from it for its benefit or in its favor, provided that this does not reduce the User/Customer’s contractual or legal guarantees.

 

Failure to exercise any right available to Arcádia® does not constitute a waiver or limitation of those rights or actions, nor does it release the User/Customer from fulfilling their obligations; Arcádia® reserves the right to exercise its rights within the legally established period.

 

FORM OF COMMUNICATIONS

In accordance with applicable legislation, by using this website, the User/Customer accepts that, as a rule, communications will be made in writing and on a durable medium.

 

Accordingly, as a rule, the User/Customer will be contacted via the email address they provide.

 

Furthermore, whenever necessary, Arcádia® will post notices to Users/Customers on this website.

 

Accordingly, the User/Customer accepts the use of electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent electronically satisfy the legal requirement that such communications be made in writing. This condition does not affect legally recognized rights.

 

LOYALTY PROGRAM – ARCÁDIA CLUB®

What is it?

 

Arcádia Club is Arcádia®’s loyalty program, through which customers receive benefits for choosing to purchase its products.

 

How can I join?

 

Joining the program is free, and customers can join through the website. If you would like to register now, click here.

 

Who can use it?

 

Membership is nominative, and the benefits granted are strictly personal; membership details may not be sold or loaned. Each member may have only one participation in the program, and membership identification within the program is personal and non-transferable. Each member’s data may not be disclosed to third parties, and the user is responsible for all operations carried out with, for, or through their account.

 

What are the benefits?

 

Arcádia® awards Arcádia Club members 1 point for every €10.00 spent on products purchased. Once 5 points have been accumulated, members receive a €2.50 voucher that can be used on future purchases in Arcádia physical stores.

 

From time to time, Arcádia® may offer special, temporary promotions exclusively for Arcádia Club members.

Program Terms, Cancellation, and Changes

 

Arcádia® reserves the right to change the criteria for awarding benefits provided under the Clube Arcádia program, as well as to cancel or amend the program conditions.

 

To use the benefits, members must identify themselves in the Clube Arcádia program using the Customer's mobile phone number. Arcádia reserves the right to cancel participation and Clube Arcádia benefits whenever a member fails to comply with the Terms and Conditions of this program, does not meet the conditions described, or uses it abusively and/or fraudulently.

 

The benefits provided by the Clube Arcádia program are not compatible with or cumulative with those of other ongoing promotions, except where otherwise indicated.

 

At any time, members may decide to cancel their membership in the Clube Arcádia program by requesting this via online@arcadia.pt. Cancellation entails leaving the program, ending the member's relationship with the program and terminating the member's benefits under it.

 

If the Clube Arcádia program is terminated, the Customer acknowledges that any points credited to them will be automatically canceled, with no right to reimbursement.

 

OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES:

In the event of a dispute, the User/Customer may refer the matter to an Alternative Consumer Dispute Resolution Entity.

If the transaction concluded between the consumer User/Customer and Arcádia® was completed through our website, in accordance with EU Regulation No. 524/2013, the User/Customer may attempt to resolve any dispute out of court by accessing the online dispute resolution platform at http://ec.europa.eu/consumers/odr/.

APPLICABLE LAW. JURISDICTION OF THE PORTUGUESE COURTS:

The use of the website, as well as the transactions, contracts, and business conducted through it, and the interpretation and application of these general terms and conditions, are governed by Portuguese law.

 

Any dispute arising from the use of the website, transactions, contracts, and agreements concluded through it, or the application of these general conditions shall fall exclusively under the jurisdiction of the Portuguese courts.
